Some records may be excluded on the basis of one or more exemptions found in the Act. Records that are commonly exempt or subject to withholding include:

  • The identity of a confidential informant or information that could identify one.
  • Personal information whose disclosure would not advance a legitimate public or private interest.
  • Information that could endanger the life or physical safety of law-enforcement personnel.
  • Records sealed or expunged by the order of a court
  • Information intended for use in a prospective law-enforcement action.

One particularly important qualification: not every investigative record remains permanently closed. Under KRS 17.150(2), intelligence and investigative reports generally become subject to public inspection if a decision not to prosecute has been made.

Open Records Requests may also be submitted online through the Kentucky State Police website or via email by forwarding the drafted request to the state police official email address. Even though records are generally not available at the time a request is submitted, the web portal may help searchers state precisely what records they need and view previous requests still in process on the portal.

If the individual has been convicted for the offense, searchers may look up their custody information by visiting the Kentucky Online Offender Lookup portal (KOOL). They will need to provide the offender's last name, first name, middle name, and any known aliases.

If an arrest was carried out by a federal law enforcement agency and a charge was filed, the resulting criminal proceedings are generally handled through the federal court system rather than the Blair County courts. Records of the resulting criminal case may be available through the Public Access to Court Electronic Records (PACER) system. PACER allows registered users to search federal court records by a party's name or case number and access available docket information and case documents, including information concerning charges, court proceedings, and final dispositions. The platform generally charges fees for access to records.

If the individual is subsequently sentenced to a term of imprisonment in a federal correctional facility, the Federal Bureau of Prisons (BOP) Inmate Locator may provide information about the person's federal incarceration. Individuals may search the locator using identifying information such as the individual's name or BOP register number.

Regarding the record sought to be inspected, requesters will need to provide specific description, including the date, time, location or case number to assist custodians in identifying the record.

If the record exists, but not in possession of the Boone County Sheriff's Office, the Custodian of Records will, in their response, direct the requestor to the appropriate agency in possession of the record.

How to Find Arrest Records for Free in Boone County

For records maintained by the Boone County Sheriff's Office, the standardized request form contains a fee structure applicable to the varying record formats available for review and collection at the Boone County Sheriff's Office. While individuals typically need to pay fees to obtain records, some resources may provide these records for free.

The Kentucky Online Offender Lookup portal allows individuals to freely examine records of persons who have been adjudged guilty and sentenced for an offense. State law requires that the record be signed and described with sufficient specificity.

How to Get an Arrest Record Expunged in Boone County

Expungement in Boone County, Kentucky, is a process that allows eligible individuals to clear criminal records, making arrests, charges, or convictions hidden or treated as if they never happened. In most cases, individuals seeking a petition for expungement will need to obtain an official eligibility certificate from the state, complete an application form and file the form alongside a formal petition, and the applicable fees.

An expungement certification may not be necessary in a range of cases, such as if the charges were dismissed, or if the person was acquitted, or if the felony charges did not result in an indictment. The processing time for the expungement certification process is 4 to 5 months.
